This privacy policy contains the privacy policy concerning the use of these websites: otolabs.com, thinkdesktop.com, indesktop.com, and polythink.com; which collectively are called the "Named Websites."

This policy does not cover the use of any other website. Other websites owned by OTOlabs, such as ionMX.net and ionMX.com, OTOlabs’ email marketing platform sites, have their own privacy policies. If you do not agree with those policies, please do not use those other sites.

This privacy policy is in four parts. The first part contains the privacy policy concerning use of the Named Websites. The second part contains the privacy policy concerning the use of OTOlabs products downloadable from the Named Websites ("Downloadable Products"). The third part contains policies that apply to the use of links to other websites contained in the Named Websites and in the Downloadable Products. The fourth part describes the effective date of these policies and our right to change them.

Your use of any Named Website or Downloadable Product constitutes your agreement to the terms of this Privacy Policy. If you do not agree with this policy, please do not use the Named Websites or Downloadable Products.

I. WEBSITE PRIVACY POLICY

Collection and Use of Personally Identifiable Information
This Named Websites are owned by OTOlabs, LLC ("OTOlabs"). You can visit any Named Website without providing OTOlabs any personally identifiable information about yourself.

Personally Identifiable Information is information that can be directly associated with a specific person or entity, such as name, postal address, or email address.

OTOlabs collects personally identifiable information about visitors to the Named Websites only from those visitors who choose to complete ("opt-in") the required fields and submit a query using any "request information" or "contact us" form contained in a Named Website. The personally identifiable information that OTOlabs collects from such a visitor is limited to information contained in the completed fields and whatever other personally identifiable information the visitor may include in his or her inquiry. OTOlabs uses such personally identifiable information only for the purpose of responding to the visitor’s inquiry.

OTOlabs collects the email addresses of persons who choose to sign up for its newletters using any "sign-up for updates" form contained in the Named Websites. You may opt-out of receiving such newsletters by following the instructions at the end of each newsletter and your email address will be deleted from our files. OTOlabs uses such email addresses only for the purpose of sending its newsletters to those who have requested them.

OTOlabs maintains physical, electronic and procedural safeguards to protect the personally identifiable information obtained from visitors to the Named Websites. We also restricts access to such information to those employees and agents of OTOlabs to that which is necessary to perform their jobs.

Should OTOlabs contract with a third party for that third party to provide a service to OTOlabs, OTOlabs may provide your information to such a third party. By written agreement, such third parties are required to implement similar security measures and to process your information only as authorized by OTOlabs to fulfill the service that they have been contracted to provide.

Other than to these third party service providers, OTOlabs generally does not share personally identifiable information with third parties. OTOlabs will not associate any data collected about users of this website with personally identifiable information, or share any personally identifiable information, except as this policy provides.

OTOlabs reserves the right to share information when we have a good faith belief that it is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable terms of use or service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of OTOlabs, its users or the public as required or permitted by law. OTOlabs also reserves the right to share information in connection with the sale, merger, consolidation, change in control, transfer of substantial assets, or reorganization or liquidation of our business.

Collection and Use of Non-Personally Identifiable Information
Cookies: Many websites store information in a small text file on your computer called a cookie. There are several types of cookies. A first-party cookie is used by a website that you are currently viewing. The Named Websites use first-party cookies to maintain a consistent experience during your visit.

A third party cookie is used by a website different from the one that you are currently viewing. A common use for this type of website is to track your web page use for advertising and other marketing purposes. The Named Websites use third party cookies for those purposes. Except as described above, OTOlabs will not link the information collected by third party cookies to any personally identifiable information.

Pixel Gifs: OTOlabs uses action tags (aka: Web beacons or pixel gifs) on the Named Websites to understand web site usage and to resolve any problems, for example, in navigation, thus enhancing users’ experience at the sites. Except as described above, OTOlabs will not link the information collected by the use of pixel gifs to any personally identifiable information.

II. DOWNLOADABLE PRODUCTS POLICY

The Downloadable Products available on the Named Websites are owned by the OTOlabs clients ("Clients") for whom they were produced. Our Clients’ use of any information you may provide to them is not controlled by OTOlabs, and under no circumstances is OTOlabs responsible for the practices of any Client. Your use of any Downloadable Product is subject to the terms of any license, privacy policy, or terms and conditions referred to or disclosed in that Downloadable Product. You should read them before using any Downloadable Product.

Whether you can use any Downloadable Product without disclosing personally identifiable information depends on the particular product. Certain Downloadable Products require that you provide personally identifiable information before you can use them. Others may collect personally identifiable information during your use of the product. No Downloadable Product collects personally identifiable information about you unless you choose to provide it.

The personally identifiable information that you provide using a Downloadable Product is either (i) submitted directly to the Client that owns the Downloadable Product, or the Client’s agent which is hosting the Downloadable Product, or (ii) collected and stored on OTOlabs servers for the benefit of the Client. In either case, the Client owns the collected information. Where the information is submitted directly to the Client or its agent, OTOlabs never sees the information and has no right to use it. Where the information is collected and stored on OTOlabs servers for the Client, OTOlabs is contractually prohibited from accessing that information except to provide services to the Client and the users of the Client’s Downloadable Product. OTOlabs is also contractually prohibited in that case from accessing or using the collected information for OTOlabs’ own purposes.

Certain Downloadable Products allow you to enter the email address of another person and share content with them or invite them to download and enjoy the benefits of the Downloadable Product. OTOlabs collects and uses that email address only to send the invitation to the other person and purges the email address from its records after sending the invitation.

OTOlabs does not control the security of information you provide when using Downloadable Products that are hosted by its Clients or their agents. In addition, the information that you provide may not be transmitted over a secure connection. Consequently, OTOlabs is not responsible or liable to you for the security of any information that you provide while using a Downloadable Product that is hosted by a Client or its agent, or the security of any information while it is being transmitted, and you provide such information at your own risk.

The security of any information stored on OTOlabs servers is important to us. OTOlabs maintains physical, electronic and procedural safeguards to protect the personally identifiable information obtained from users of Downloadable Products hosted on OTOlabs servers for a Client. We also restricts access to such information to those employees and agents of OTOlabs to that which is necessary to perform their jobs. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we endeavor to safeguard your information, we do not guarantee its security.

OTOlabs will not associate any data collected from Downloadable Product users with personally identifiable information, or share any personally identifiable information collected from the users of Downloadable Products that it hosts for a Client, to third parties other than to that Client and third party service providers, except as this policy provides.

Subject to the paragraph just before this one, OTOlabs in no way links the information collected using such mechanisms to any personally identifiable information.

III. LINKS TO OTHER SITES

This privacy policy governs only the Named Websites and Downloadable Products. Named Websites and Downloadable Products may contain links to websites controlled or offered by third parties. OTO has no control over such websites or the privacy policies of the third parties who maintain them. It is incumbent on you to read the privacy policies applicable to those websites and decide whether to make use of them. OTOlabs makes no representation or warranty concerning the privacy policies governing the use of those websites and the links to such websites do not imply any endorsement of or responsibility for those privacy policies.

IV. EFFECTIVE DATE AND RIGHT TO CHANGE POLICY

This notice describes OTOlabs’ Privacy Policy as of October 12, 2007. OTOlabs may change this Privacy Policy at anytime and from time to time. Because OTOlabs does not, in general, collect personally identifiable information from visitors to Named Websites or from users of Downloadable Products, we have no way of notifying most users should OTOlabs change its privacy policy or of giving you the opportunity to opt-out. However, if we decide to change our privacy policy, we will post notice if there have been material changes on our home page so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we share it. Your use of our products or websites after we post such notice will constitute your acceptance of the changes.
